What it is about
The most common mistake in Austria is assuming that the federal level settles the matter. Permits, zoning and refusals happen in the provinces.
The Austrian division of competences is hard to read and has direct consequences. The federal level sets the frame, the provinces enforce, and in some fields they legislate themselves. Building, nature protection and spatial planning are provincial, trade and installation law is federal, and in between sit procedures where both levels have a say.
For companies that means a position that works in Vienna has to be explained again in Graz, Linz and Innsbruck, often to people with different interests. We therefore work from maps rather than mailing lists, and establish early where a project can actually fail.

Who is responsible for my issue in Austria?
That can only be settled against the specific project. As a rule of thumb, commercial law, tax, telecommunications, energy market design and trade law sit with the federal level. Building codes, spatial planning, nature protection and large parts of installation procedures sit with the provinces. Many projects touch both.
Do I need separate advice for Austria and the EU?
Separate advisers rarely, separate work almost always. Most commercial law originates at EU level and is transposed nationally. What works is playing both levels with a position that stays the same in Brussels and in Vienna.
